Are businesses ready to be inspected by undercover agents?

Stores and stalls could be being evaluated by undercover agents of the Defensoría del Consumidor (DC) or the Ministerio de Economía (MINEC), due to the recent reforms presented to the Legislative Assembly.

The deputies of the Economy Commission yesterday issued a favorable opinion to this reform to the Consumer Protection Law in order to harmonize it with the Administrative Procedures Law.

The rule for "undercover delegates" will serve to verify compliance with promotions and offers, verify price increases of goods and services for credit card purchases or differentiators for cash purchases, abusive practices, misleading or false advertising, special obligations and prohibitions for financial service providers and verify price differences between the price offered or regulated by the Law and the one verified.

But be careful, these persons authorized to carry out the evaluations will arrive at the sales establishments or stores without any notice and without any identification of any institution.

It should be noted that the reform to the Law improves the protection of consumers in electronic commerce by establishing the obligation for suppliers to create mechanisms to deal with complaints and their registration before the Defensoría del Consumidor.

Among the other amendments that issued the favorable opinion are: fines for failure to deliver products on time, intervention in cases of over-indebtedness, combating illegal advertising.

According to the officials, the homologation of these regulations will allow the Salvadoran economy to evolve and the institutions to develop their vigilance to protect the consumer.
