The Ministerio de Trabajo y Previsión Social (MTPS) will implement the “Justicia Laboral Nocturna”, program, an initiative that seeks to expand labor inspections to workplaces that operate at night. The announcement was made by the Minister of Labor, Rolando Castro, who stated that the objective is to ensure that both workers and employers comply with the provisions established in labor legislation.
According to Castro, the program involves the formation of a team that will conduct inspections at night, with the purpose of directly verifying the working conditions of people who work after 4:00 or 5:00 p.m. and during the night. In this way, the Ministry seeks to expand its supervisory capacity to productive sectors whose operations are concentrated outside of traditional working hours.
One of the main aspects that will be reviewed during these inspections is compliance with labor rights, including the correct payment of wages and the conditions under which workers perform their duties. The minister emphasized that those who work at night must have the guarantees established by law, including the corresponding recognition for night shifts when applicable.
Castro said that these provisions should not depend on the individual interpretations of workers or employers, but rather are part of compliance with labor legislation. Under this premise, the Ministry of Labor intends to verify that companies with nighttime operations comply with the established obligations and that workers receive the benefits to which they are legally entitled.
The program also seeks to strengthen the Ministry’s institutional presence in the so-called nighttime productive sector, which includes economic activities that operate during the afternoon, evening, and early morning. The implementation of specialized teams will allow for verifications to be carried out during the same hours in which these shifts take place, facilitating direct supervision of working conditions.
According to the official, the strategy is part of a progressive expansion of labor inspection coverage. The intention is that supervision will not be limited to conventional hours, but will also reach workers who, due to the nature of their jobs, perform their duties at night.
The Ministry of Labor maintains that the employment relationship must balance the rights and responsibilities of workers and employers. In this regard, inspections will not only be aimed at identifying potential violations by companies, but also at promoting awareness and compliance with the responsibilities established by labor regulations for both parties.
With the launch of “Justicia Laboral Nocturna”, the Government seeks to expand oversight of compliance with labor laws and ensure that people who work at night have decent working conditions and receive the corresponding pay for their shifts. The program will be officially presented by the Ministry of Labor as part of its strategy to extend labor protections to more sectors of the economy.
