Changes or possible creation of a new Labor Code announced

The minister of Labor, Rolando Castro, published in his Twitter account that he will hold meetings with union movements, in order to update the Labor Code, which according to the official is outdated.

 

 

The work tables will begin next tuesday, and it is anticipated that, depending on the results, some articles will be altered or a new Code will be created, which according to minister Castro, will be updated to modern labor conditions.

The current Labor Law, as the official pointed out, dates back 50 years, so some of the areas to be changed could be: the minimum wage, which according to article 145 of the Code, establishes that it will be fixed based on the cost of living, type of work performed and depending on the production areas.

On the insurance, it is likely that there will be changes in the benefits given to employees, since the current law in its article 362, does not oblige employers to insure their employees, in case the activities they perform do not represent a risk to their lives, as established by the Dirección General de Previsión Social.

In the current security context, it has been observed that foreign citizens are migrating to El Salvador in search of job opportunities, however, article 7 of the current Code establishes that employers must have 90% of national employees, so it is possible that the issue will be discussed.

Articles 35 to 60, which talk about the termination of contracts, is another area that may enter the meetings due to new technologies, since it is likely that certain industries will no longer need human labor.

In the area of maternity, articles 309 through 312, which describe the rights and duties of employers and employees, will probably see changes in the amount of leave provided to women after childbirth or in other health and newborn child protection issues.

Other issues likely to be on the table include health and safety, retirement, workers' compensation, employee death benefits, employee spousal benefits, and improved employee benefits.
