
Representatives of the Commission for Infrastructure and Territorial Development issued a favorable ruling for the creation of a regulation that will allow the transfer of property to the Fondo Nacional de Vivienda Popular (FONAVIPO with the objective of legalizing and delivering them to more than 60 families in the Barrio La Aduana community, in the district of Puerto El Triunfo.
The initiative seeks to guarantee legal security for families who have inhabited these lands for years without having property titles. To this end, a special mechanism was created within the Property Transfer Law that will allow the Ministry of Hacienda to transfer land to FONAVIPO, an entity that will later be responsible for its legalization and free delivery to beneficiaries.
The Barrio La Aduana community is in an urban area located at the intersection of 1st Avenida Sur, 3rd Calle Poniente and Avenida Osegueda. The main building has a total extension of 9,216.13 square meters, of which more than 7,400 are inhabited by families. Furthermore, a second piece of land measuring 1,573 square meters is included, which was declared unused by the council in 2023 to facilitate its assignment.
The process of implementing this transfer has advanced in different stages. In july 2023, the Council of Ministers authorized the transfer of properties to FONAVIPO, a decision that was ratified in May 2025 before being sent to the Legislative Assembly for its final approval.

Deputy Ángel Lobos said that this measure responds to a historic demand from the community, whose inhabitants have been waiting for decades for the legalization of their land. As explained, with this regulation families can obtain deeds and secure heritage for their children and future generations.
If the law is approved, people who have occupied land continuously for at least 10 years will benefit. Furthermore, they will have access to support or financing programs offered by FONAVIPO to improve their homes, if they comply with the established requirements.
The legalization process will include several steps. The Ministry of Housing will carry out a census of beneficiaries and coordinate the allocation of land. Through the Property Legalization Directorate, measurements, lot delimitation and procedures will also be carried out before the National Registry Center for their formal registration.
The Ministry of Hacienda will assume the payment of municipal debts pending on the main property until entry into force of the law. Once this stage is completed, FONAVIPO will continue with the administrative processes to formalize the transfer to each family.

Although it is a project of social interest, the process will be free from taxes, registered rights and other costs, facilitating access to property. However, benefiting families cannot sell, rent or transfer property for a period of 20 years, to avoid speculation and ensure that the benefit fulfills its social purpose.
Finally, the regulations establish that the fiscal general, Rodolfo Delgado, will be in charge of signing the property donation deed in representation of the State.
With this initiative, the authorities seek to settle a historical debt with the community, providing legal certainty over their homes and contributing to improving their living conditions through access to secure heritage.
